The ASTM International (ASTM) E1527 Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process and the ASTM E2247 Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process for Forestland or Rural Property are similar standards and share most of the same requirements. ASTM E2247 is intended to be an alternative approach to ASTM E1527 for forestland or rural property when some of the methodologies outlined in ASTM E1527 may be impractical or unnecessary due to the nature and size of the property.

When to Apply ASTM E2247

Large acreage properties on forestland or rural settings, including solar and/or wind sites and utility corridors used for transmission lines or pipelines, are typically the best candidates to use ASTM E2247. The ASTM E2247 standard is intended to provide a more practical approach to these larger properties. However, the environmental professional should decide which ASTM standard to follow considering not only the nature and size of the property, but also typical environmental concerns, readily available sources for interviews and records reviews, appropriate methodologies to perform the site reconnaissance, and client requirements or preferences. Land that does not meet the definition of forestland or rural properties should be addressed using the methodologies provided in ASTM E1527. However, the presence of buildings at a property does not necessarily exclude land from meeting the definition of forestland or rural properties, as these areas may contain structures such as residences, barns, sheds, garages and greenhouses.

Three Key Differences Between ASTM E1527 and E2247

It is important to note how these two environmental site assessment standards differ to successfully complete the project.

ASTM E2247-16 and ASTM E1527-13 share the same definition of a recognized environmental condition. The recent ASTM E1527-21 revised the definition.
Under ASTM E2247-16, a recognized environmental condition is defined as the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to any release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment.

Under ASTM E1527-21, a recognized environmental condition is defined as (1) the presence of hazardous substances or petroleum products in, on, or at the subject property due to a release to the environment; (2) the likely presence of hazardous substances or petroleum products in, on, or at the Subject Property due to a release or likely release to the environment; or (3) the presence of hazardous substances or petroleum products in, on, or at the Subject Property under conditions that pose a material threat of a future release to the environment.

These differences in the definitions should not materially impact what are identified as concerns or affect how the environmental professional identifies concerns. However, they are the reason that stating a Phase I ESA was conducted in accordance with both standards is not appropriate. For example, if a small convenience store is located within a larger area being assessed using ASTM E2247, it would be more appropriate to state E1527 methodologies were used to assess the convenience store as opposed to stating the whole report meets both standards.

The environmental professional is required to establish appropriate methodology to complete the site visit under both standards. However, ASTM E1527 recommends a grid pattern or symptomatic approach be used and that both the interior and exterior portions of onsite buildings are visually inspected. As ASTM E2247 is typically used for larger properties, the recommended methodology is to view the property via publicly accessible roads and pathways or flyover. Prior to conducting the site visit, areas of interest should first be identified via review of aerial photographs, environmental database documentation and other sources. Areas of the property visually inspected during an ASTM E2247 site visit include areas that can be seen from roads and pathways, areas of interest that have not been ruled out as concerns by interviews and the exteriors of structures at the property. ASTM E2247 does not require that the interiors of structures be assessed but leaves this up to the opinion of the environmental professional.

ASTM E1527 lists aerial photographs, topographic maps, fire insurance maps, local city directories, building department records, interviews, property tax files and zoning and land use records. ASTM E2247 only lists aerial photographs and topographic maps.
The size of properties for which we use ASTM E2247 necessitates that historical resource information gathered is presented differently than in an ASTM E1527 report. Standard database packages can accommodate properties that are 640 acres or less. Many of the larger renewable energy development for which ASTM E2247 is used are more than 640 acres and are comprised of multiple parcels. For these properties, an Area Study Report is needed. The Area Study Reports do not contain physical setting information. This information will need to be obtained from other resources as part of the Phase I ESA. However, in the case of solar and/or wind projects, this information may be gathered as part of other scope items within the project.

Aerial photographs and topographic maps can be ordered as tiffs or prints. Preferably, aerial photographs and topographic maps should be ordered as tiffs. An expert GIS consultant from TRC can electronically stitch the aerial photographs and topographic maps together using GIS referencing data that is accessed via webviewer. The use of a webviewer allows the team to view these resources more effectively and allows the report writer to zoom in and out for better visibility while describing the resources. If aerial photographs and topographic maps are ordered as prints, the report writer must manually piece the flight lines together, which is problematic for reuse in updates and in reviews. EDR Lightbox only works for standard packages and does not allow an online review of aerial photographs and topographic maps for these larger sites.

ASTM E2247 does not require that city directories or fire insurance maps are obtained. Many of the properties contained in the larger forestland and rural properties sites do not have addresses and have no fire insurance map coverage; therefore, these resources are not particularly helpful. If environmental professionals choose to order city directories for an entire site, they should make sure to include all streets within the footprint of the site. In the event specific parcels within a site appear to present an environmental concern, obtaining city directory information along cross streets for these isolated portions of the site can be useful to determine specific parcel ownership and utilization history. Because larger properties assessed using ASTM E2247 are commonly located in rural areas, TRC’s GIS experts note the presence of cemeteries and orchards on aerial photographs, Google Earth imagery and topographic maps as these property uses present potential environmental concerns. We also identify pipelines and oil and gas wells via online resources (e.g., website maintained by applicable state and federal agencies).

EDR must provide individual quotes for database materials on a per project basis for larger sites. These also need to be ordered through your EDR representative as opposed to the website directly. Frequently, providing a shapefile of the site to the environmental database firm contact is necessary to obtain an accurate quote.

Reporting and Communication Methods

After the site visit and research is complete, it should be noted that the report template for ASTM E1527 and ASTM E2247 Phase I ESAs are similar. However, the size of the properties involved in ASTM E2247 Phase I ESAs presents a challenge to clearly communicate observations. In these cases, a tabular summary of information on a per parcel basis may better communicate concerns identified. The table should be included as an appendix to the report and can be referenced in the report for a more streamlined presentation. For proposed solar and/or wind projects where the client may not have finalized the footprint, this per parcel summary allows clients to eliminate problematic parcels from purchase or plan development around concerns.

Next Steps

TRC recommends that ASTM E2247 be considered when assessing large forestland and rural properties. However, for projects where the use of ASTM E2247 is most appropriate, the project manager should be budgeting for proper costs to obtain data, time required to complete a webviewer and the additional time required to address a larger site. The timeline to complete an ASTM E2247 Phase I ESA as described is approximately four to six weeks.

TRC Assists in Securing $11M in funding for small Communities

April 14, 2023

The U.S. Environmental Protection Agency (EPA) published a proposed rule in the May 13, 2016, Federal Register that would extend the requirements of the Site Remediation National Emission Standards for Hazardous Air Pollutants (NESHAP) regulations (40 CFR Part 63, Subpart GGGGG) to previously exempt soil and groundwater remediation activities under CERCLA and RCRA. Many current and future remediation projects across a range of industries may now be subject to this greatly expanded rule. EPA is proposing to amend the NESHAP by: Removing current exemptions for site remediation activities conducted under CERCLA, a RCRA corrective action or other RCRA order; Revising the applicability provisions to include stand-alone site remediation projects with the potential to emit 10 tons per year of a single hazardous air pollutant (HAP) or 25 tons per year for a combination of HAPs (major source of HAPs); and Requiring remediation at current operating facilities which are major sources of HAPs to comply with the rule even if the remediation by itself is not a major source of HAPs. EPA estimates the number of current locations affected by this new rule could be at least 69; however, this estimate may be low. The rule includes 97 organic HAPs which may be contained in remediation material (e.g., soil, groundwater) during the removal, destruction, degrading, transforming, immobilizing, or otherwise managing the material. The rule is triggered if more than 1 Mg/yr of remediation material is managed. Rules for metals have been deferred. The rule requires either air pollution control equipment or work practices on the following types of remediation activities: Vapor/liquid extraction systems which have process vents. There are emission limitations to be achieved if emissions are above a threshold. Tanks and containers which have vents are subject to the process vent rule, but those without vents are subject to tank design and work practice standards. Impoundments of certain sizes and HAP content would be subject to covering and treating emissions. Process equipment would be subject to leak detection and repair programs such as in effect at chemical plant and refineries. Subject facilities would be required to perform rigorous compliance testing, monitoring and reporting. Existing site remediation activities (before May 13, 2016) that become newly subject to the Site Remediation NESHAP, as a result of these proposed amendments, would be required to comply with the rule within 18 months from the date the final rule is published in the Federal Register. New sources, constructed on or after May 13, 2016, would be required to be in compliance on the effective date of final rule amendments or upon startup, whichever is later. Comments on the proposed rule are due by June 27, 2016 and can be submitted via Docket ID No. EPA–HQ–OAR–2002–0021 at http://www.regulations.gov. TRC can help clients prepare/submit comments and/or evaluate their remediation systems to make sure they are not major HAP sources and complete the 1 Mg/yr calculation which determines what if any compliance requirements they might have. If the remediation facility is a “new” major HAP source and managing more than 1 Mg/yr; clients can make sure none of the five control bullets above apply. Even if remediation projects don’t have any emission controls/work practices, they still need to document this in writing. When considering a new remediation project, clients are urged to evaluate the applicability of the proposed rule. The following flow chart can help with this review.

Additional Restrictions for Major Modifications Other restrictions will come into play for new Major Sources, those that have a potential to emit 50 tons per year or more of VOC or NOx and “major modifications” that result in a VOC emission increase that exceeds 25 tons per year and also exceeds 25 tons per year when aggregated with all creditable increases and decreases in emissions of VOC from the source over any period of five consecutive years, which includes the calendar year in which the increase will occur. For sources that are major due to NOx emissions, a NOx emission increase that exceeds 25 tons per year and exceeds 25 tons per year when aggregated with creditable increases and decreases over the five-year period is also deemed to be a major modification. If a major modification occurs, the source is required to utilize the Lowest Achievable Emission Rate (or LAER) for the pollutant(s) that exceed 25 tons per year aggregated over the five-year period. However, Best Available Control Technology (BACT) can be substituted for LAER under certain conditions. Additionally, emissions must be offset as a means to advancing the area toward attaining the ozone standard. These same requirements will apply to newly constructed Major Sources. Upcoming Deadlines With these actions, the impacted areas will now have until August 3, 2027, to reach attainment.  If they do not, USEPA is again obligated to reclassify ongoing nonattainment status to Severe nonattainment, reducing the Major Source threshold in half to just 25 tons per year. In the meantime, the states will be required to revise State Implementation Plans to demonstrate that attainment will be achieved by this deadline. A unique consideration in Wisconsin affects sources subject to a Registration Operation Permit. These permits establish annual emission limits as a percentage of the Major Source threshold (25, 50, or 80 percent depending on the Permit). For these sources, the annual emission limit for VOC and NOx will automatically be cut in half on January 16, 2025. Sources in the ozone nonattainment areas that hold these permits should evaluate whether the Registration Permit provides a long-term option given that the annual emission limits have been cut in half now and may again be cut in half in three years’ time. For sources that are major due to NOx emissions, a NOx emission increase that exceeds 25 tons per year and exceeds 25 tons per year when aggregated with creditable increases and decreases over the five-year period is also deemed to be a major modification. If a major modification occurs, the source is required to utilize the Lowest Achievable Emission Rate (or LAER) for the pollutant(s) that exceed 25 tons per year aggregated over the five-year period. However, Best Available Control Technology (BACT) can be substituted for LAER under certain conditions. Additionally, emissions must be offset as a means to advancing the area toward attaining the ozone standard. These same requirements will apply to newly constructed Major Sources. Upcoming Deadlines With these actions, the impacted areas will now have until August 3, 2027, to reach attainment.  If they do not, USEPA is again obligated to reclassify ongoing nonattainment status to Severe nonattainment, reducing the Major Source threshold in half to just 25 tons per year. In the meantime, the states will be required to revise State Implementation Plans to demonstrate that attainment will be achieved by this deadline. A unique consideration in Wisconsin affects sources subject to a Registration Operation Permit. These permits establish annual emission limits as a percentage of the Major Source threshold (25, 50, or 80 percent depending on the Permit). For these sources, the annual emission limit for VOC and NOx will automatically be cut in half on January 16, 2025. Sources in the ozone nonattainment areas that hold these permits should evaluate whether the Registration Permit provides a long-term option given that the annual emission limits have been cut in half now and may again be cut in half in three years’ time. NERC’s plan calls attention to the need for thoughtful integration of IBRs and identifies current and future work required to mitigate reliability risks resulting from the deployment of this technology.

Faced with an aging fleet, stricter environmental regulations, reduced costs for natural gas and competition from renewables, more than 600 power plants have been decommissioned in the last 20 years, a pace that will increase with the announced closure of nearly 350 additional plants by 2025. With a goal of being net-zero carbon by 2050, many power generators are faced with critical decisions regarding their thermal generation plants. Should they continue operation, repower, re-purpose or retire their plants? In the competitive power generation market, coal-fired plants are getting squeezed on multiple fronts including lower prices for renewables (e.g., wind and solar) and gas, inefficient cyclical operation and, in some instances, by state efforts to curtail the use of coal. Foregoing the retail market and partnering with a data center for mining cryptocurrency can represent a winning financial proposition for both parties. Some states are actively encouraging the co-locating of data centers at generation sites, while others are actively working to keep plants operational in order to preserve the jobs at the plants and in the mines. In some regional transmission organizations, such as PJM, newer natural gas fired generation units are favored over older units because of their more efficient turbines and larger size. Older natural gas units are at risk of becoming stranded assets as cheaper renewables come online and the industry commitments to net zero emissions. There are reports that banks Citigroup Inc and JP Morgan Chase & Co will strengthen their financing restrictions on thermal gas plants, similar to what they’ve already done for coal projects.

NERC Addresses Single Points of Failure in Protection Systems Among Other FERC Concerns

In 2017 Oregon Governor Kate Brown took bold action by directing state agencies to chart a 10-year course towards greater energy efficiency in affordable housing to help remove the energy burden on low-income communities. This initiative took flight under the direction of the Oregon Housing and Community Services, the Oregon Public Utility Commission and the Oregon Department of Energy, which created the newly released Ten-Year Plan: Reducing the Energy Burden in Oregon Affordable Housing. Last summer, OHCS hired TRC to assist in the development of these two deliverables. As the Project Lead, I was given the opportunity to experience first-hand both the excitement and challenges of this initiative. After almost 15 years working on low-income energy efficiency programs, this project allowed me to view this familiar topic through a new lens. Instead of designing a building-level incentive program, I was focused on the low-income population – the actual people living with energy challenges – and evaluating how efficiency could help to reduce their economic, health and housing burdens. One of my first discoveries was an analysis of the energy burden gap of the low-income population in Oregon that showed the difference between a typical low-income household’s actual energy costs and an affordable energy cost (6 percent of the household’s income) is significant – and totaled $345 million statewide in 2017. (Nationwide, that gap is over $47 billion per year.) Despite my surprise at the size of this gap, I still wasn’t prepared for what we found next.

NERC Proposes Compliance Monitoring and Enforcement Plan for 2019

This month, NERC released the first draft of its 2019 Compliance Monitoring and Enforcement Plan (CMEP) which identifies power delivery system risks and outlines compliance audit requirements for next year. The risk elements outlined in the plan include significant differences from previous years, as shown in the table below. Each NERC region must consider these risks as they develop their monitoring and audit scopes for utilities. Utilities should be prepared to be audited and implement any necessary compliance initiatives in these areas.
